21、.1消費(fèi)者維權(quán)和正確使用的依據(jù) The basis of the consumers’ right protection and the proper usage,案例一Case One,上海的劉女士為新房購(gòu)買了一套布藝沙發(fā),用了一段時(shí)間后便將沙發(fā)布套拆下來(lái)清洗。在清洗過(guò)程中,她沒(méi)有考慮就用水洗,并且認(rèn)為用高水溫容易去垢,怎么進(jìn)行晾曬也不考慮,結(jié)果該沙發(fā)布套不但退色,而且縮水量較大,不能再套回原沙發(fā)上了,投訴咨詢到了質(zhì)監(jiān)部門,負(fù)責(zé)接

22、待的人員問(wèn)她購(gòu)買的沙發(fā)產(chǎn)品是否隨附有家具使用說(shuō)明,她說(shuō)有,她看后才發(fā)現(xiàn),使用說(shuō)明中規(guī)定: 沙發(fā)布套洗滌方法為干洗。結(jié)果只好自認(rèn)倒霉。Ms. Liu from Shanghai bought a fabric sofa for her new house, after a period of time she removed the sofa sets for cleaning. She didn’t know whether it c

25、ions for use was sofa sets should wash by dry cleaning.,案例二Case Two,消費(fèi)者汪先生是北京人,去年5月份在深圳出差時(shí)相中了一套全實(shí)木家具,銷售人員當(dāng)時(shí)表示:“全實(shí)木家具不含人造板,甲醛不會(huì)超標(biāo),安全;而且這套家具是手工打造的,牢固?!蓖粝壬吹叫录揖呓Y(jié)實(shí)大方,又沒(méi)有刺激性氣味,就花大價(jià)錢購(gòu)買了一套。誰(shuí)知家具到家后,汪先生逐步發(fā)現(xiàn)家具出現(xiàn)了“變化”:家具邊框與面板交接的地方

43、.3執(zhí)法部門仲裁執(zhí)法的依據(jù)The Basis of The Arbitration and Law Enforcement,欺詐問(wèn)題:一般的家具問(wèn)題,買賣雙方基本能協(xié)商解決,特殊家具產(chǎn)品不僅具有收納貯存功能,還有藝術(shù)收藏功能,如一套烏紋木或大紅酸枝紅木家具,不僅價(jià)格不菲,還具有中國(guó)傳統(tǒng)文化特色,一旦出現(xiàn)消費(fèi)糾紛,買賣雙方一般都不能協(xié)商解決,需要借助有關(guān)協(xié)商團(tuán)體機(jī)構(gòu)或執(zhí)法部門來(lái)解決。紅木家具具有硬木家具特色,木材含水率對(duì)家具質(zhì)量影響較大

60、6.6-2004《消費(fèi)品使用說(shuō)明 第6部分:家具》標(biāo)準(zhǔn)發(fā)布實(shí)施以來(lái),卻沒(méi)有得到商家和消費(fèi)者的重視,實(shí)施效果較差。如有些家具的使用說(shuō)明只是簡(jiǎn)單的一頁(yè)紙,無(wú)法將必要的內(nèi)容標(biāo)示齊全,實(shí)際作用非常有限;有些家具的使用說(shuō)明文字大部分為英文,缺乏必要的中文解釋,消費(fèi)者不易看懂;還有絕大部分家具的使用說(shuō)明書放在包裝中,消費(fèi)者往往在拆開包裝時(shí)只顧核對(duì)家具的情況而忽視了說(shuō)明書的存在,被消費(fèi)者當(dāng)作廢紙一樣丟掉。造成這些問(wèn)題的原因主要有以下幾點(diǎn):Probl

66、 of content format.,3.1宣傳宣貫力度有待加強(qiáng) Propagation Need Strengthened,可操作性不強(qiáng):GB 5296.6-2004適用于所有家具產(chǎn)品,在3.1中規(guī)定:出售的家具必須具備使用說(shuō)明(標(biāo)簽、標(biāo)牌、使用說(shuō)明書等)。這個(gè)要求在實(shí)施中理解不一,廣大媒體宣傳說(shuō)“出售的家具必須有使用說(shuō)明書”;家具生產(chǎn)廠不知什么樣的家具使用標(biāo)簽,什么樣的家具使用標(biāo)牌,什么樣的家具要使用說(shuō)明書。監(jiān)督檢驗(yàn)部門執(zhí)行操作
