23、lveasplitcannotbechanged.Alllocalitiesdepartmentstothevillage“nounauthised“created出租車(chē)公司的管理辦法出租車(chē)公司的管理辦法第一章總則第一條為了加強(qiáng)出租汽車(chē)行業(yè)管理，規(guī)范經(jīng)營(yíng)和管理行為，提高服務(wù)質(zhì)量，保護(hù)乘客、出租汽車(chē)駕駛員、出租汽車(chē)經(jīng)營(yíng)者的合法權(quán)益，根據(jù)有關(guān)法律、法規(guī)，結(jié)合本省實(shí)際，制定本辦法。第二條本辦法適用于本省行政區(qū)域內(nèi)從事出租汽車(chē)經(jīng)營(yíng)及管理活動(dòng)。本

24、辦法所稱出租汽車(chē)，是指具有合法營(yíng)運(yùn)資格，按照乘客意愿提供客運(yùn)服務(wù)，以行駛里程或者時(shí)間計(jì)費(fèi)的5座以下的小型客車(chē)。第三條縣級(jí)以上人民政府交通運(yùn)輸主管部門(mén)負(fù)責(zé)本行政區(qū)域內(nèi)的出租汽車(chē)行業(yè)管理工作。規(guī)劃、公安、監(jiān)察、財(cái)政、人力資源社會(huì)保障、住房城鄉(xiāng)建設(shè)、價(jià)格、工商、質(zhì)監(jiān)、稅務(wù)等部門(mén)，按照各自的職責(zé)，做好出租汽車(chē)的相關(guān)管理工作。第四條出租汽車(chē)是城市綜合交通體系的重要組成部分?？h級(jí)以上人民政府應(yīng)當(dāng)根據(jù)經(jīng)濟(jì)社會(huì)和城市發(fā)展，制訂出租汽車(chē)發(fā)展規(guī)劃。第五條從

25、事出租汽車(chē)經(jīng)營(yíng)應(yīng)當(dāng)依法取得許可，任何單位和個(gè)人不得封鎖或者壟斷出租汽車(chē)市場(chǎng)。第六條出租汽車(chē)管理應(yīng)當(dāng)遵循公開(kāi)、公平、公正和便民的原則，促進(jìn)出租汽車(chē)市場(chǎng)健康有序發(fā)展，滿足廣大人民群眾的出行需求。出租汽車(chē)經(jīng)營(yíng)者和駕駛員應(yīng)當(dāng)依法經(jīng)營(yíng)，誠(chéng)實(shí)守信，公平競(jìng)爭(zhēng)，文明服務(wù)。第七條鼓勵(lì)出租汽車(chē)經(jīng)營(yíng)向規(guī)?；?、集約化發(fā)展。推廣信息化管理和使用環(huán)保、節(jié)能車(chē)型。第二章經(jīng)營(yíng)權(quán)管理第八條各地應(yīng)當(dāng)采取以企業(yè)綜合素質(zhì)和服務(wù)質(zhì)量為主要條件的招投標(biāo)方式配置出租汽車(chē)經(jīng)營(yíng)權(quán)，擇優(yōu)

49、連續(xù)兩年不合格的。第三章從業(yè)資格管理第十七條出租汽車(chē)駕駛員實(shí)行從業(yè)資格考試制度。出租汽車(chē)駕駛員應(yīng)當(dāng)經(jīng)考試合格，取得從業(yè)資格證后方可從事出租汽車(chē)營(yíng)運(yùn)活動(dòng)。出租汽車(chē)駕駛員從業(yè)資格考試大綱、考試辦法和從業(yè)資格證件式樣，由省人民政府交通運(yùn)輸主管部門(mén)規(guī)定。第十八條申請(qǐng)出租汽車(chē)駕駛員從業(yè)資格考試的，應(yīng)當(dāng)符合下列條件：(一)年齡在18周歲以上60周歲以下，無(wú)職業(yè)禁忌癥(二)取得相應(yīng)的機(jī)動(dòng)車(chē)駕駛證，并有2年以上駕齡(三)3年內(nèi)無(wú)一般以上主要責(zé)任交通事故

50、記錄。第十九條申請(qǐng)出租汽車(chē)駕駛員從業(yè)資格考試的，應(yīng)當(dāng)向出租汽車(chē)經(jīng)營(yíng)所在地縣級(jí)以上人民政府交通運(yùn)輸主管部門(mén)提出，并提交符合本辦法第十八條規(guī)定的相關(guān)材料。第二十條出租汽車(chē)駕駛員的從業(yè)資格證有效期為6年。出租汽車(chē)駕駛員應(yīng)當(dāng)在從業(yè)資格證有效期屆滿30日前到原發(fā)證機(jī)關(guān)辦理?yè)Q發(fā)證件手續(xù)。出租汽車(chē)駕駛員從業(yè)資格證件遺失、毀損、變更工作單位的，應(yīng)當(dāng)?shù)皆l(fā)證機(jī)關(guān)辦理補(bǔ)發(fā)或者變更手續(xù)。第二十一條出租汽車(chē)駕駛員有下列情形之一的，縣級(jí)以上人民政府交通運(yùn)輸主管部

51、門(mén)應(yīng)當(dāng)暫停其從業(yè)資格，并要求其重新學(xué)習(xí)考試考試合格的，方可繼續(xù)從事出租汽車(chē)經(jīng)營(yíng)活動(dòng)：(一)一年內(nèi)被有效投訴服務(wù)質(zhì)量事件達(dá)3次及以上的(二)發(fā)生重大以上主要責(zé)任交通事故的(三)將出租汽車(chē)證件轉(zhuǎn)借他人使用的(四)將出租汽車(chē)轉(zhuǎn)包給他人經(jīng)營(yíng)或者自行聘請(qǐng)駕駛員的。第二十二條出租汽車(chē)駕駛員有下列情形之一的，由發(fā)證機(jī)關(guān)注銷(xiāo)其從業(yè)資格證：(一)持證人申請(qǐng)注銷(xiāo)的(二)駕駛證被依法吊銷(xiāo)或者注銷(xiāo)的(三)年齡超過(guò)60周歲的(四)從業(yè)資格證有效期屆滿后未申請(qǐng)換證
