簡(jiǎn)介:重慶大學(xué)博士學(xué)位論文論環(huán)境法的社會(huì)法屬性姓名王哲民申請(qǐng)學(xué)位級(jí)別博士專業(yè)指導(dǎo)教師陳伯禮20110608重慶大學(xué)博士學(xué)位論文第三部分為“環(huán)境權(quán)的社會(huì)權(quán)屬性解析”。從社會(huì)法的視角考察公民環(huán)境權(quán),明確環(huán)境權(quán)的社會(huì)權(quán)屬性,提出環(huán)境權(quán)的設(shè)立不僅是解決社會(huì)個(gè)體利益沖突的法律手段,更主要的是為解決社會(huì)整體的利益沖突。由于民法在解決環(huán)境問(wèn)題中存在著諸多局限性,構(gòu)造環(huán)境權(quán)的法技術(shù)應(yīng)為入憲和由環(huán)境保護(hù)基本法做出專門規(guī)定及制定保護(hù)公民環(huán)境權(quán)的特別法,在對(duì)環(huán)境權(quán)進(jìn)行立法設(shè)計(jì)時(shí),突出國(guó)家政府在相關(guān)法律關(guān)系中的作用,確保環(huán)境權(quán)益能夠及時(shí)得到救濟(jì)。第四部分為“社會(huì)法視野下的環(huán)境責(zé)任”。分析我國(guó)社會(huì)立法中社會(huì)法責(zé)任缺失的原因,闡述社會(huì)法責(zé)任的形態(tài)、功能和社會(huì)法本質(zhì)。在此基礎(chǔ)上從社會(huì)法責(zé)任的視角對(duì)環(huán)境污染侵害案件中無(wú)過(guò)錯(cuò)責(zé)任原則的適用展開(kāi)討論,分析泛用無(wú)過(guò)錯(cuò)責(zé)任存在的弊端。指出無(wú)過(guò)錯(cuò)責(zé)任原則應(yīng)與其他機(jī)制銜接和協(xié)調(diào),提出無(wú)過(guò)錯(cuò)環(huán)境污染受害者補(bǔ)償?shù)纳鐣?huì)法調(diào)整機(jī)制。明確污染受害者的對(duì)應(yīng)義務(wù)主體除了排污者,還有國(guó)家和社會(huì)組織,社會(huì)法上建立在國(guó)家補(bǔ)償和扶持基礎(chǔ)上的基金制度與保險(xiǎn)制度,都能夠在民法領(lǐng)域之外實(shí)現(xiàn)對(duì)無(wú)過(guò)錯(cuò)污染受害者的補(bǔ)償救濟(jì)。第五部分為“社會(huì)法視野下的環(huán)境公益訴訟”。探討社會(huì)法視野下對(duì)環(huán)境權(quán)利的司法救濟(jì),闡述了社會(huì)法的“集團(tuán)公益訴訟”應(yīng)與“民事訴訟”相分離,總結(jié)了社會(huì)法集團(tuán)公益訴訟的訴訟形態(tài)。并進(jìn)一步論述了我國(guó)在構(gòu)建環(huán)境公益訴訟制度時(shí)應(yīng)引入美國(guó)式集團(tuán)訴訟、團(tuán)體直接訴訟和示范訴訟等社會(huì)法集團(tuán)公益訴訟的訴訟模式。關(guān)鍵詞環(huán)境法,社會(huì)法,法律屬性,環(huán)境權(quán),環(huán)境法律責(zé)任Ⅱ

簡(jiǎn)介:隨著人民健康需求日益增長(zhǎng),公立醫(yī)院已經(jīng)越來(lái)越難以滿足人們多層次、多元化的醫(yī)療服務(wù)需求,加之衛(wèi)生費(fèi)用的逐年增加,政府財(cái)政負(fù)擔(dān)日益加重。激勵(lì)和引導(dǎo)社會(huì)辦力量辦醫(yī)療機(jī)構(gòu),引入市場(chǎng)競(jìng)爭(zhēng),加快形成以公立醫(yī)療機(jī)構(gòu)為主導(dǎo),非公立醫(yī)療機(jī)構(gòu)共同發(fā)展的多元化辦醫(yī)格局勢(shì)在必行。改革開(kāi)放以來(lái),尤其是新一輪醫(yī)藥衛(wèi)生體制改革以來(lái),我國(guó)出臺(tái)了一系列社會(huì)辦醫(yī)方面的利好政策,社會(huì)辦醫(yī)呈現(xiàn)出較快增長(zhǎng)的趨勢(shì),但與公立醫(yī)院的發(fā)展仍存在著較大的差距,我國(guó)社會(huì)辦醫(yī)的發(fā)展環(huán)境仍有待改善,發(fā)展?jié)摿τ写诰颉1狙芯恐饕菍?duì)社會(huì)辦醫(yī)發(fā)展環(huán)境的優(yōu)化措施進(jìn)行探索。在文獻(xiàn)調(diào)研法、PESTSWOT分析法、歸納總結(jié)法、小組座談法等研究方法以及博弈理論的基礎(chǔ)上,明確國(guó)內(nèi)社會(huì)辦醫(yī)的歷史發(fā)展階段宏觀分析我國(guó)社會(huì)辦醫(yī)的發(fā)展現(xiàn)狀構(gòu)建PESTSWOT分析模型從16個(gè)維度對(duì)社會(huì)辦醫(yī)的發(fā)展環(huán)境進(jìn)行了分析,為社會(huì)辦醫(yī)的優(yōu)化發(fā)展提供決策從博弈論的視角對(duì)社會(huì)辦醫(yī)的利益主體進(jìn)行了博弈分析,論證政策落實(shí)不力的原因?qū)?guó)內(nèi)典型省市、典型國(guó)家和地區(qū)的社會(huì)辦醫(yī)現(xiàn)狀、問(wèn)題和做法進(jìn)行了歸納總結(jié),進(jìn)一步為我國(guó)社會(huì)辦醫(yī)的發(fā)展環(huán)境的優(yōu)化提供借鑒和參考。

簡(jiǎn)介:南京師范大學(xué)碩士學(xué)位論文媒介環(huán)境對(duì)青少年社會(huì)化進(jìn)程的影響姓名劉荃申請(qǐng)學(xué)位級(jí)別碩士專業(yè)教育技術(shù)指導(dǎo)教師張舒予李藝200351媒介環(huán)境對(duì)青少年社會(huì)化進(jìn)程的影響中文摘要傳播技術(shù)的發(fā)展,極大地影響了人們對(duì)世界的認(rèn)知。媒介環(huán)境對(duì)青少年意味著什么,如何有效利用媒介環(huán)境引導(dǎo)青少年的健康成長(zhǎng),一直是教育界和傳播界關(guān)注的焦點(diǎn)。人的社會(huì)化貫穿于人的一生,青少年時(shí)期是人的社會(huì)化的關(guān)鍵時(shí)期。青少年渴望通過(guò)接觸媒介環(huán)境,滿足包括道德觀形成、社會(huì)交往和娛樂(lè)文化等多種心理、____?!馹’一需求,自主地實(shí)現(xiàn)“社會(huì)化”進(jìn)程。為了更好地研究媒介環(huán)境對(duì)青少年社會(huì)化進(jìn)程的影響,筆者對(duì)南京市的部分初中二年級(jí)學(xué)生進(jìn)行了抽樣調(diào)查并安排了一次對(duì)比實(shí)驗(yàn)。以考察青少年接觸媒介時(shí)的心理與行為特征。調(diào)查和實(shí)驗(yàn)表明,青少年在接觸媒介時(shí)表現(xiàn)出某些明顯的傾向性。、筆者認(rèn)為,媒介環(huán)境是青少年接觸社會(huì)的主要途徑。通過(guò)媒介環(huán)境,青少年獲得了社會(huì)化所必需的信息和榜樣。這些媒介信息不僅影響青少年道德觀的發(fā)展,而且為青少年群體的形成提供了途徑和話題,并進(jìn)一步為青少年獲得娛樂(lè)、形成亞文化提供了可能。但媒介環(huán)境對(duì)青少年也有負(fù)面作用,如信息良莠不齊,某些媒介會(huì)占用青少年大量的閑暇時(shí)間等,這一類問(wèn)題不容忽視。我們應(yīng)以寬闊的視角研究媒介環(huán)境對(duì)青少年社會(huì)化進(jìn)程的影響,合理構(gòu)建青少年精神世界自主建構(gòu)平臺(tái),彰顯人文精神,為青少年?duì)I造一個(gè)良好的媒介環(huán)境//,關(guān)鍵詞青少年,媒介環(huán)境,社會(huì)化’吣第1頁(yè)
