3、 or unofficial corporate and individual such as rulers, politicians, government officials, propagandist and entrepreneurs. “Since the middle Ages, the principle of university self-determination has been highly praised an

4、d regarded as the intrinsic logic of the development of higher education. An autonomous culture has been gradually formed in the West because of the traditional role of university autonomy. The culture exists not only in

5、 higher education and self-government relations, but also in whole society. It is the culture that guaranteed autonomy of higher school and greatly promoted the development of higher education in the West. In our country

6、, with the introduction of the modern university in the 19th century the University autonomous system was introduced. However University autonomy seriously conflicted with the academic value views of Chinese tradition ch

7、aracterized by the attachment to imperial authority from the outset. As a result university autonomy was amended and higher schools greatly were controlled by the government. Particularly after the founding of New China,

8、 the management of higher education has always followed the principle of plan because of the impact of highly planned system. For long term the higher schools in our country didn’t enjoy autonomy of running school. The s

9、chools turned into the subsidiaries. Due to deficiencies of autonomy in the long period of time, higher schools have been accustomed to running school according to the commands of the government and the ready-made standa

10、rds of society. After passive adaptation becoming a habit, higher schools unconsciously play the roles of the governmental subordinates and social subsidiaries. When higher schools lost in the self-awareness, accordingly

11、, to a considerable extent, they lost the capacity for self-development or even unconsciously abandoned to pursue excellence. Max Weber thought that any organization must enjoy some rights. An organization can’t achieve

12、their goals without some rights. He divided the rights of the human society into three kinds: traditional rights from traditional practices or hereditary authorities; charisma rights from the worship of others; legal rig

13、hts from ration or laws. He pointed out that ideal organizations is sustainable and can achieve their goals only basing on the legal rights. Higher schools can successfully achieve organizational goals if they hold legal

14、 rights. China's “Higher Education Law” was enacted so that the autonomy of higher school based on laws. Higher schools can’t enjoy complete self-governing rights because of many obstacles. One of the obstacles is th
