1、我國的法律語言學(xué)研究起步較晚,多側(cè)重于立法語言的靜態(tài)句法特征、功能的理論探討,而對司法領(lǐng)域的法律與語言、法律問題與語言現(xiàn)象之間的關(guān)系的動態(tài)語言研究除了廖美珍先生外則很少有人涉足。專門從庭審會話的語用特點入手,進行合作原則及其會話含義在庭審會話中的適用問題的研究則更不多見。
本文試圖以格萊斯的會話含義理論為主并輔以廖美珍先生的目的原則為理論框架,結(jié)合話語分析的方法,從語用學(xué)的角度對庭審會話進行研究。本文以法庭審判的實踐為出發(fā)點,
2、摘錄了二十一個庭審片段進行分析,描述了庭審中參與者間的互動機制及庭審話語的特點并揭示了法庭問答主體內(nèi)的互動關(guān)系、互動機制以及問答策略,還針對庭審語言應(yīng)用的某些具體問題進行了研究,對法庭問答互動中會話合作原則理論的應(yīng)用及其意義進行了分析。本文旨在探討格萊斯的會話含義理論在庭審語言中的適用性,進一步證明法律語言研究的必要性和重要性,從而更好地利用語言機制來發(fā)揮會話含義理論在庭審語言中的作用。
